Understanding Agency Relationships in Georgia

Whether you are a home buyer or home seller, working with a real estate professional can help take the anxiety out of the real estate transaction. In today's real estate climate, whether you are a seasoned veteran to the home buying and/or home selling process, having someone represent your interests can help you avoid the pitfalls which can occur - particularly during a time of foreclosures and short sales. Georgia real estate law is very clear on the responsibilities of all licensed real estate professionals and their duty to their client (or customer). As you begin your real estate journey, know the benefits and the differences to Georgia's Real Estate Brokerage Relationships.

Brokerage relationships in Georgia fall into one of two categories: (1) broker-client relationship or (2) broker-customer relationship. All Broker-Client relationships must be in writing to comply with Georgia real estate law. If a buyer chooses not to engage a real estate agent to represent them in writing, it is referred to as a broker-customer relationship. In this instance the Broker is not representing the buyer in a legal OR agency capacity. The categories for broker-client representation in Georgia fall under these categories: Dual Agency, Designated Dual Agency and Buyer Agency. A REALTOR® is a registered collective membership mark and can only be used by a real estate professional who is a member of the National Association of REALTORS® thus subscribing to - and, must answer to a very strict Code of Ethics in addition to abiding by Georgia real estate law.
